Shariah Issues in Islamic Banking : Bay Al-Inah, Tawarruq and Wa’d

Abstract The rising of the Islamic banking and finance industry is a direct response to the growing awareness amongst Muslim regarding the need of alternative financial products and services that is complied with the teaching of Islam. To be specifically, the demand is based on the avoidance of the element of Riba which is widely and fundamentally practiced in the conventional banking industry. The attempt by the Islamic banking and finance industry had so far been successful and it could be witnessed by the launching of wide range of Shariah compliant financial products and transaction.However, none of us can guarantee that the Shariah compliant products approved are fault-free absolutely. Among the practices of the industry, the practice of Bay al-Inah or the practice of sale and buy-back, Tawarruq which quite commonly used in Malaysia, have been criticized strongly especially the voices from the Middle East. The other issue that will be discussed briefly in this project paper is t he applicability of Wa’d , the unilateral promise. SHARIAH ISSUE ONE: Bay al-Inah THE CONCEPTLinguistically, the term â€Å"Inah† carries t he meaning of salaf, or contracting a loan. It is used in this meaning to refer to purchasing on credit. It could also be a derivative of the term â€Å"ayn†, which also means present assets, that is cash. Thus, it denotes a situation whereby one purchases an asset for its subsequent sale on cash that is needed by him. Bay al-Inah is generally defined as an arrangement whereby a seller sells to the buyer some object for cash deferred payment; then, simultaneously, the seller mmediately buys back the same object for a lesser amount than the deferred price in cash. Thus, the transaction amounts to a loan whereby the difference between the two prices represents the interest . Modus Operandi: The above diagram shows the modus operandi of the Bay al-Inah that has been practiced by the Islamic banks in Malaysia so far. In this transaction, the bank sells its asset to the customer who is in need of liquidity on credit. The price under the sale includes the bank’s profit margi n charged on the customer.Subsequently, the bank buys back the asset from the customer for cash payment. Eventually, the customer gets the cash payment, and pay the bank the deferred price over a tenure by periodic instalments which constitutes the same effect and result of a loan . CURRENT PRACTICE IN THE INDUSTRY In Malaysia, the practice of Inah may take 2 names, depending on the original owner of the asset. If the asset to be used belongs to the customer, the contract is known as Bay Bithaman Ajil (BBA). If the asset belongs to the bank, then the contract will be named as Bay al-Inah. ven though the legal documents may differ from one financing to the another, but the common documentation will consist of Property Purchase Agreement (PPA) and Property Sale Agreement (PSA). Besides, the Master Facility Agreement will also be prepared to encapsulate and detail out all necessary ingredients of the facility granted. These documents reveals that though the two sale contracts are execu ted separately without making one of them conditional to the other, the master facility Agreement has clearly indicated the intention of the parties in entering into these two consecutive sale contracts.LEGITIMACY OF BAY AL-INAH The main proponents of Bay al-Inah is the Shafii school. The Shafii jurists have illustrate their permissibility in a situation whereby a person sells a commodity on cash or credit terms and hands over possession, and the parties separate with mutual pleasure about the contract, it is permissible for him to purchase it from the previous buyer for an amount equal to, higher, or lower than the former price, of the same currency as before or different, paying cash or oncredit, after receiving payment for the previous sale or before it.On this basis, according to the authoritative position upheld by the Shafii scholars, the two independent contracts, jointly referres to as â€Å"Inah† are held valid, but reprehensible. This principle even applied when one of the two parties is known for the practice of Inah, as according to the principle upheld by the Shafii school, the intention of the parties, even when it happens to be unacceptable, does not result in the invalidity of the contract, unless such intention is given expression in the contractual text.As a result, it will be the case whereby even the situation indicates the parties’ intention to carry out a second sale, this will not necessitate the invalidity of the contract. In a simple word, the Shafii school considered the intention of the parties only taken into account when the invalid intention is explicitly written in the contract . In the other side, the Maliki and Hanbali schools opined that the contract of Bay al-Inah is not valid.The Maliki jurists have categorized the process in question under buyu’ al-ajal, which concerns on the discussion of various form of two sale contract being taking place in sequence involving combination of different prices and peri ods. They have described 9 possible variations, the permissibility of two of which have been subjects of different opinions, while there is unanimity pertaining to the rest. It was said that when one sells a commodity on a deferred payment and thereafter purchases it again, the price in the second transaction could be deferred for a period equal to the first, shorter than the first, or longer.In each of these situations, the price of the second transaction could be equal to that of the first, lower than, or higher. The types where jurists have differed are: -where the price of the second transaction is lower than that of the first, and is on a cash basis; and -where the price of the second transaction is higher than that of the first and is deferred for a longer period. Imam Maliki and other jurists regard these formats invalid.They considered the second transaction along with the first, and regard the grounds viable enough to suspect that the purpose is to exchange an amount of mon ey with a higher amount that is deferred, which substantially constitutes the prohibited Riba. Hence, the transaction acts as a medium for attaining what is prohibited and it is invalid inherently. The Hanbali school agreed that the Bay al-Inah is not valid as the difference of the selling price of a commodity with profit margin and the lesser buying price transaction serve as an avenue leading to Riba.One could seek to legalise the sale of one thousand against one thousand five hundred by involving an asset in this manner. But, it was also mentioned that if the price of the second transaction is equal to that or higher than the first transaction, then it is permissible since no margin equal to the nature of Riba is involved. The above ruling applies where the commodity had not diminished in any manner after its sale. If it had diminished, it could be purchased at any price, as any decrease in the price could be against the loss of value in the asset, and not for the purpose of Riba .If the purchase is against another asset, or the first sale was against an asset and the commodity is then repurchased for cash, it is permissible due to the fact that Riba is not applicable between money and commodities. If the first sale is on cash, and the second sale takes place through another currency, it is permissible. Basically, the determination of validity in contract is based on the parties’ motive and validity in sale under consideration, the motive of the parties is illegal will put the sale invalid aas it constitutes a legal device to obtain a loan with interest which should be averted.Imam Hanifah from the Hanafi school opined that if the two prices are such that Riba could be applicable such as gold and silver, and are identical in type, for example: gold, it is not allowed to repurchase the sold commodity except at a price equal to the first, without any increase or decrease in price. If the price of the first sale was such that Riba is not applicable, such as commodities, he may repurchase the sold commodity for a price higher than the initial price or lower.If the two prices belong to different types where Riba is applicable such as gold and silver, disparity between them although analogically permissible, but is unlawful based on Istishsan. The majority objection to Bay al-Inah were supported by a number of Hadith attributed to the Prophet and his companions. One of the example was the Hadith that the Prophet warned those who practiced Bay al-Inah with calamity (bala’) or disparagement (dhill). Another example was a report on a Bay al-Inah transaction that had been brought to the knowledge of Aishah r. a. hich read: â€Å"Aliyah binti Ayfa said: I entered Aishah’s place with Umm Walad of Zaid bin Arqam and his wife. Then, Umm Walad of Zaid bin Arqam said: I had sold a slave to Zaid bin Arqam for 800 dirhams on deferred payment. Then I bought him back from Zaid for 600 dirhams cash. Aishah replied: Very bad is what yo u sold and bought. Convey to Zaid that he had nullified his struggle with the Prophet, unless he repented. † ALTERNATIVE SOLUTION Al Ijarah al Muntahiya Bittamleek Under this structure, the bank appoints customer to be its agent to make purchases from the seller.The customer then takes the purchased asset on lease from the bank, for rental payments. At the end of the lease period, the asset will be transferred to the customer via a sale (normally the price of the last rental payment) or as a gift. SHARIAH ISSUE TWO: Tawarruq THE CONCEPT Tawarruq has been generally used to refer to an arrangement whereby a person who was in need of cash bought some goods for deferred payment. Then he sold the goods to another party other than the original seller for payment of cash with a lower price . Tawarruq is considered an alteration based on the Bay al-Inah.The distinction between the Bay al-Inah and Tawarruq is that the person who requires liquidity purchases an asset from a seller on cr edit, thereafter sells it on cash basis at a price lower than the purchase price to the seller in the case of Bay al-Inah. However, Tawarruq involves a third party whereby the one who requires liquidity purchase an asset from someone on credit, and thereafter sells it, usually for a lower price, to a person other than the original seller. So, the structure does not give a direct indication of Hilah solely to undercover the Riba.Modus Operandi: CURRENT PRACTICE IN THE INDUSTRY The concept of Tawarruq contract is popular among the contemporary Islamic financial system. In fact, the short term financing which various adaptions of Murabaha was used as the standard mode by the majority of Islamic banks in the industry is in deed structurally designed based on this Tawarruq principle. However, there are some variation on the simple structure of Tawarruq due to the reason the Islamic banks encounter objections from the classical scholars with the similar stand and analogy as the way they e nounced the Bay al-Inah. One of the most popular variation is the Tawarruq Masrafiy. In this mode of Tawarruq Masrafiy, the Islamic bank is acting as a mere intermediary and does not possess the asset that could be readily brought into the Tawarruq financing process and therefore is in need of liaising with a trader/ broker, usually an external party, for the purpose of facilitating the Tawarruq contract. Similarly, the disposal of such asset by the customer of the facility needs to be further simplified by the mediation of an agent.Hence, this Tawarruq Masrafiy could be more complex in its structure . Modus Operandi: LEGITIMACY OF TAWARRUQ Most of the scholars make their conclusion on the validity of Tawarruq based on the same authorities and analogy of the validity of the Bay al-Inah. The scholars who have upheld the permissibility of Tawarruq have fundamentally relied on the general connotation of the verse permitting sale while prohibiting usury. Tawarruq as a type of sale, is i ncluded within this context of permissibility due to the absence of any Quranic verse or Hadith that rules it unlawful.The proponents somemore cited the Hadith reported by the Companion Abu Said al-Khudri which narrates that a man from the region of Khaybar who had been contracted the upkeep of a plantation came to the Prophet with some dates of good quality. When the Prophet asked him whether all dates of Khaybar were of similar quality, the man replied in the negative and added that they used to obtain a measure of better dates against two measures of ordinary dates, and two measures against three measures.The Prophet forbade him from doing so and directed him to sell the low quality dates against silver coins, and then purchase better dates against silver . This Hadith indicates the permissibility of using the described method for avoiding involvement in Riba overtly or covertly; the medium of a sale is employed, which fulfils all conditions and prerequisites of sales, free of fa ctors that result in its invalidity. The intention of procuring dates of better quality as the end result of the transaction has not been considered to invalidate the material structure.Hence, this shows that the legality og the sale transaction where different purposes are intended when the medium utilized is acceptable and free of Riba explicitly and implicitly. As a conclusion for the proponents, it is permissible to attain liquidity through a medium of sale such as the case of Tawarruq when there is a need for doing so. On the other hand, the denouncers of the Tawarruq have mainly concentrated on the aspect of intention.They argues that the intention here is to procure money, which could tentamount to the sale of money against a different amount of money, while the asset serves only as a medium, the acquisition of which is not primarily intended. Therefore the structure strongly connotes the p[ossibility of a legal stratagem adopted for this purpose. thus a major reason for the disapproval of tawarruq is that it appears to be a Hilah adopted for attainment of what could otherwise be Riba. It is money against money, with a piece of silk cloth pushed in between. † as the stand of Ibn Abbas when he was asked on the question regarding the permissibility issue. One of the frequent cited authorities by these denouncers is the Hadith which reported that The Prophet has said: A time is certainly coming to mankind when people will bite each other and a rich man will hold fast what he has in his possession though he has not commanded for that.Allah the Almighty said: (and do not forget liberty between yourselves), and then those who are forced to contract sales while the Prophet forbade forced contracts, one which involves some uncertainty and sales of fruits before they are ripe. In a simple word, the end result of the whole transaction is their main concern in determining the legality of a particular structure of transaction. Hence, the Tawarruq is deemed no thing but equally to the practice of Riba as the purpose of Tawarruq is to obtain instant cash for a higher consideration later.In the OIC Islamic Fiqh Academy in its 15th Meeting, it was decided that the Tawarruq is allowed. However, in its later meeting, ehich is the 17th Meeeting, the OIC Islamic Fiqh Academy clarified its stand on Tawarruq by stating that the Tawarruq Masrafiy that largely adopted by the Islamic financial institutions is disallowed. The reasoning behind the disapproval is that the Tawarruq Masrafiy practiced by the Islamic banks is in the form of organized Tawarruq or pre-planned Tawarruq rather than ad hoc Tawarruq which cuasing it almost synthetic and fictitious as Bay al-Inah in essence.ALTERNATIVE SOLUTION Since the problem of Tawarruq shares the similar features of the Bay al-Inah, the alternative solution could be the same as discussed in the former part. Hence the Al Ijarah al Muntahiya Bittamleek could be the substitution for both Bay al-Inah and Tawarru q as a solution for avoiding the Riba element concerned. SHARIAH ISSUE THREE: Wa’d THE CONCEPT The 3-letter root WA-A-D (wa’d), corresponding to the verb Wa’ada, indicates a promise but can also be used for a threat.The technical definition of Wa’d (promise) is based upon the linguistic definition, affirming the positive meaning and excluding the negative meaning (threat). A promise has to be for something Ma’ruf (recognized as good by the Shariah and sound intellect). If a promise is to do something evil or wrong, then it is not obligatory to fulfill it and the time in which a promise is to be fulfilled is the future, not the time at which the promise is made. The problem incurred in application of Wa’d is that some banks claim that their unilateral promise (Wa’d) is not binding.However if the customer breaks his/ her unilateral promise, then the bank charges the customer for the loss incurred as a result of not fulfilling his unilat eral promise . LEGITIMACY OF WA’D The resolution 1409H of the Islamic Fiqh Academy has decided that a unilateral promise (Wa’d) which is issued unilaterally by either orderer or the client, is by religion binding upon the promisor except where otherwise justified. It is also judicially binding if it is made contingent upon a reason and if the unilateral promise (Wa’d) entails a cost for the unilateral promise (Wa’d).Insuch cases, the consequences of the binding character of the unilateral promise (Wa’d) are determined by either the fulfillment of the unilateral promise (Wa’d) or by reparation for losses actually incurred as a result of the non-fulfillment of the unilateral promise (Wa’d) without justification. According to the resolution of the Islamic Fiqh Academy that prohibits the Wa’d to be binding on both parties but allowed it to be so on one of them, it is rather too arbitrarily and hardly acceptable. It should be the ot her way round whereby one should treat the Wa’d either binding on both parties or optional for both parties.Making it binding upon one to the exclusion of the other, is illogical and denotes a misinterpretation of jurisprudential principles. In a summary, it is admissible for Wa’d as an alternative to a invalid contract to be binding because Wa’d is analogous to a contract as well. Any suggestion for making it binding upon both or either parties explicitly or impliedly with any other Hilah is not founded on any legitimate basis. SOLUTION The Wa’d is at its best to be excluded in the practice of the Islamic banking legal documentation system due to the uncertainty and arbitrariness.However, the characteristic of the Wa’d might be implemented through a contemporary form of statutory declaration in declaring certain sub-condition for the contract between the bank and customer instead of the main terms and conditions of the contract. For example, if th e real estate was brought on the purpose for self-staying purpose instead of profit generation, then the statutory declaration may be made in declaring this. This might not be the main issue in the construction of the bank’s facility agreement which must be included within the terms but can be proclaimed in the way of declaration.For the consideration and/or performance that is much important which will affect both parties essentially, of course must be included in the facility documents entered by the parties and there is no point to make it in a rather uncertainty form of Wa’d. CONCLUSION The Al Ghazali once said that the very objective of the Shariah is to promote the welfare of the people and whatever ensures the safeguarding of people’s faith, life, intellect, posterity and wealth serves the public interest and is desirable.In the issue of Wa’d, it is certainly not the best form of contracting to the Islamic banking industry that put much demand on c ertainty, hence it would be rather fully utilize the bilateral contract on main consideration/performance or only using the statutory declaration on the least important issue such as the example given since the ambiguity part of the Wa’d is not serving the public interest for all. From the point of Shariah, the Bay al-Inah and Tawarruq is not really serving the welfare of people and it has similar oppressive character of Riba.The banks are still getting the pre-determined rate of return and the application of Bay al-Inah or in other name BBA and Tawarruq is mostly cosmetic. If the Islamic banks label their hamburger as a MECCA burger, as long as it still has the same ingredients as a McDonald’s burger, is it really any different in substance? Starch Lab

Krupa Desai Cell Biology April 3, 2013 Lab: Biosynthesis of Starch Introduction: In this lab we learned the concept and procedure of synthesizing starch. We also learned the effects of pH and temperature on the reaction rates of amylase.. In the process of the synthesis lab we learned phosphorylation using a potato, which was what we synthesized. The phosphorylation took place after the addition of primer. There are two different types of starches used are amylose and amylopectin.To test for the presence of starch, the Starch Test is used. This is a simple test in which iodine is added to a given solution. If a polysaccharide such as starch is present then the iodine ion will lodge itself in the polysaccharide chain and give it a black-blue color. If iodine added to a solution turns black-blue than starch is present. If the solution remains the color of iodine, reddish-orange, there is no starch present, a negative test.In our experiment we scale the color we see in comparison to the neutrals to test for the amount of starch. As you can see with our data we had some discrepancies in tubes where glucose was present no starch should have been found however we have â€Å"+† in a few of the time slots this could be do to the interpretation of color or some spill over.Since we were trying to get exact times the drops could have splattered over into a nother part of the dish and contaminated some of the other tubes overall our data is fairly accurate however tube 7 had the most phosphorylation because it turned from blue to black over time. Some of the other tubes although had the presence of starch did not alter much over time in fact most stayed the same. Additionally it is concluded the pH and temperature greatly effect the reaction rate of enzymes.

Analysis of the Prejudice behind the Removal of Mexican American Lessons Freedom of speech is just one of the many rights we ensure as citizens of America. Everyone is entitled to his or her own opinion, or so it’s said. Sadly, it seems as though that’s not always the case. In the instance of the ban of Mexican American Studies in Arizona, the opinion of those who didn’t fully understand the concept was taken over the students and teachers fighting for their rights to education as United States residents. The decision to ban the Mexican American Studies was a biased decision and it does not make America appear equal when it comes to racial identity. When these ethnic studies were officially banned, it constituted a form of oppression for the folks who were affected by this action. The teachers whom all the students in these classes looked up to were reassigned and the bond the students had built with each other and their teachers was taken away. For some, coming to school and learning about their own heritage was a life changing experience. â€Å"Providing students a way to interact with notions of identity, history and culture in an academic setting clearly improved the graduation rates of low income Hispanic students† (Ramos 1). It gave them hope that someday things would get better, and it even created a sense of belonging in today’s society. But the individuals who supported the ban did not take the time to actually experience what went on in these classes. â€Å"The state legislature contends that these programs are indoctrinating students with anti-American biases but there has been no such evidence to suppo rt this claim† (Ramos 1). They just assumed the teachers were giving Americans a bad name for how poorly they treated Mexican Americans in previous years and wanted these students to eventually â€Å"overthrow† the government. These assumptions were certainly not the intentions of the teachers, in fact the actual intentions were just to show the students they had rights as Mexican Americans and deserved to be treated equally. Forbidding these students to obtain knowledge about equality is definitely a form of oppression. America, as a whole, has a history of poor treatment for races or ethnicities other than white, and this forbidden Mexican American Studies ban in Arizona could be the foundation of additional bans around the country. If that begins to happen, it could cause a lot of controversy nation wide with Mexican Americans because it is preventing them from learning who they really are. â€Å"The Arizona ethnic studies ban has more to do with the politics of our countries changing demography and political power then they do with educational attainment and what is best for the future of the state† (Ramos 1). This makes America look like a racist country because its citizens are disposing of the opportunity to study the history of differing races. As one student stated, â€Å"America is full of people with different backgrounds. If learning ethnic studies is anti-American, then what does it truly mean to be American?† Regrettably, it appears to mean that Americans can be very judgm ental toward others not similar to them. It’s quite unfortunate that the definition of an American is questionable. The country is constantly changing, and those who are surrounded by it must adapt. At the core of the Ethnic Studies ban is fear; much is at stake for each side. The side opposing the education of these studies is prominently made up of white officials high up in the government. They are afraid of a prospective uprising of the Mexican Americans and what consequences that may cause. There are numerous points to be taken into consideration, such as government positions potentially taken over by Mexican Americans instead of the Caucasians currently holding the positions. These white officials undoubtedly mull over the idea of losing control of the government, so to avoid any possibility of this happening they took the easy way out and got rid of any threat they may have had. The ban was placed on courses that meet the following criteria: 1) â€Å"promote the overthrow of the United States government;† 2) â€Å"promote resentment toward a race or class of people;† 3) â€Å"are designed primarily for pupils of a particular ethnic group;† or 4) †Å"advocate ethnic solidarity instead of the treatment of pupils as individuals† (Lee 1). This created a safety net for the opposing side by making sure no class like this would be taught again in Arizona. â€Å"The reality is the ethnic studies ban in Arizona is nothing more then a byproduct of a state legislature which has become adept at manufacturing crises in order to win elections† (Ramos 1). The sad reality of the situation is the fact that power is more important than the history of an entire race. The side attempting to save the Ethnic Studies assembled the Mexican American students and teachers who believed in the program and it’s success. They were fighting for their rights as American citizens for freedom of education. Not only that, but the future was at stake for almost all of these individuals. For the students, these classes kept their interest in school and education as a whole. Many anticipated graduating, going off to college, and eventually making a life for themselves. â€Å"A Tucson Unified School District (TUSD) analysis revealed the MAS programs improved the graduation rates of low income Hispanics† (Ramos 1). This shows that the curriculum immensely aided to the success of the teenagers taking the course. Without it, several of these adolescents could potentially lose interest in school and not persist with the plans they once had. It was very ironic when the new law stated â€Å"the legislature finds and declares that the public school pupils sh ould be taught to treat and value each other as individuals and not be taught to resent or hate other races or classes of people† because in their classrooms, they were all treated with dignity and respect and were taught that they had rights, too (Lee 1). Banning the Mexican American Studies is resent or hate toward the Mexican race, so the legislature is very hypocritical and unfair. The Mexican American Studies ban in Arizona was an unfortunate event for a multitude of Mexican American students and teachers. It removed so many opportunities for these people, and could potentially change the future for some. â€Å"Bottom line these programs help the educational attainment of those that need it. If there is a crisis, it is in the leadership of the Arizona State legislature, which has chosen to manufacture a controversy, when the focus should be on how best to educate Arizonas future workforce† (Ramos 1). Numerous controversies could occur and that would cause a great deal of problems. Equal rights should be dispersed for everyone living in the same region, no matter the ethnical differences.

Movie Analysis Of Sunset Boulevard Film Studies Essay Sunset Boulevard, directed by Billy wilder in 1950, is considered to be the greatest film about Hollywood ever put on celluloid by Hollywood. It is a classic black comedy/drama, and perhaps the most acclaimed, but darkest film noir story about behind the scenes Hollywood. Some people describe it as the black pearl of film noir: a macabre movie whose decadent glamour and despair are memorably haunting. The movie combines melodrama and film noir to give us a deliciously scathing satire on the movie making industry. This is why it is still regarded as a landmark of American cinema, even though it has been more than a half century since it was produced. While this film is both entertaining and striking, it is a sad tale of deception, greed, and jealousy. It begins and ends with a dead man floating in the pool of a crumbling old mansion. This movie not only pokes fun at old Hollywood, but also broke new ground with techniques never used before in film. From its legendary opening shot of a man floating dead in a swimming pool, Sunset Boulevard seizes our attention and doesnt let go until its equally famous closing shot. In fact, the movie opens with a jolt: the bullet-riddled body of a young man is seen floating face down in the pool next to a mansion. Then the ghostly voice of Joe Gillis recounts the events leading up to his death, which are shown in flashback until ending with the final scene: A completely deranged Norma Desmond descending a staircase in front of newsreel cameras. She is once again in the spotlight, even if she is unable to comprehend why, and Max, who is positioning the cameras, is directing her for one final time. Despite their apparent differences, Joe and Norma are two of a kind both are vain mediocrities who think they are better than what they are, and who seriously believe that they are destined for a better future, but they are obviously doomed. Sunset Boulevard is a movie made in Hollywood that is about making movies in Hollywood, this is why it is self referential. It critiques Hollywoods star system. In fact, the main female character of the film (Norma Desmond) plays a washed up actress from the silent age of Hollywood. She lives in a world of delusion where her fans still remember her, and where her old director Cecil B. DeMille will produce the wretched script that she is writing. Her eccentric behavior and her neurotic tendencies seem to know no limits. In this main female character the movie exposes a sad picture of the dark side of the star system: The star system exploits an artists skill, but when that actor or actress becomes obsolete, or lose their appeal to the public, the system would cut them free. At the end of the movie, she commits murder to protect her fantasy. This film expresses a cynical attitude toward Hollywood, by showing the main character of the film face down in his dream pool; killed, in a roundabout way by the Hollywood system. The dead man, we find out, is Joe Gillis, a Hollywood script writer, and also the narrator of this tale. Then Gillis takes us on a journey of how he got there through bad creditors, a car chase, a dead monkey and a very well timed landing at the home of Norma Desmond.   With that, the film can be seen as a look at the writer and the game of writing and filmmaking in Hollywood. It depicts a lack of respect for the art of writing, and the lack of humanity in the Hollywood system. From a technical standpoint, Sunset Boulevard is not a ground-breaking film, but Wilder uses the films visual elements to good effect. Experiences you will learn You will learn what you can do and the areas you need to work on in your studies. An Internship will help you gain the confidence you need to perfect your abilities. You will also gain valuable work experience. It also will give you some insight on how to solve problems with in your work area. Your internship will help you network by establishing a contact base, and references which can give you future letters of support. Internships provide hands-on learning opportunities, and also can lead to employment. All internships do not guarantee employment, but the experience is worth it. Whether you are compensated or not, the internship can provide you some academic credit to help you farther your education. There are Internships that are primarily clerical or mechanical do not qualify for academic credit, but they increase marketability to employers. On average, only 30% of graduating seniors have job offers before graduation; however, after completing an internship, that figure rises to 58%. I had never done an internship before so it was a learning experience for me. Would I do this over again probably, would I recommend an internship to someone? Yes I would, it is very rewarding growth in integrity, character, and spirituality if you let the Lord refine you, and you are able to take constructive criticism, which helps you refine your weaknesses. I think this is a great course and would recommend it to another student, thanks for the opportunity to learn and grow from this experience.

The glass ceiling is an invisible barrier in organizations that prevents many women and minorities from achieving top-level management positions. In 1995, the Glass Ceiling Commission released its first report and found that only 5 percent of the senior-level managers in Fortune 1000 companies are women. This report identified three barriers to the advancement of women and minorities: 1. Societal barriers exist that are likely outside the control of business. 2. Internal structural barriers are present that are under the direct control of business, including recruitment policies and corporate cultures. 3. There are governmental barriers such as insufficient monitoring and enforcement Taking care of the family is a major reason why women don't advance as fast as men. "We don't play golf on Saturday mornings" (Diana Bennett, president of D.L. Bennett & Associates). Whereas men may informally move up the ladder during a golf game, women are likely to be doing house chores and spending time with the kids. History of Beer Essay

Beer was probably discovered by accident, when some of the nomadic tribes of the Middle East decided to settle down to an agricultural life depending on the cultivation of grain. In times of plenty the excess might have been stored for a possible future period of failure. Due to the damp storage condition the grain might have sprouted and germinated in a desperate bid to salvage the crop they must have made porridge by boiling the sprouted grain with water. This must have released sugar into the liquid resulting in a sweet tasting porridge. This was probably left in open to cool allowing the natural yeast of the atmosphere to settle on the porridge forming alcohol or what was a crude wash. There is evidence that the brewing process was established in Babylon as early as 6000 B.C. The Egyptians improved upon this process, which was diffused along the trade routes by the Greeks & the Romans. The Romans started brewing on a commercial basis to provide a substitute to wine. The term bear today covers all beer drinks such as ales, lagers & stout. Beer gets it’s name from Anglo Saxon Word called â€Å"Beer† meaning â€Å"BARLEY†. Beer is the national alconolic beverage of Great Britain. Although the basic traditional method of brewing beer is still being used now the whole production process is controlled by the programme equipment so that each phase is carried out at the exact time required and can be corrected if necessary. By this centralised control, consistency of the brew from batch to batch is better.

Analysis Of The Fall Of Ferdinand Marcos Essay

October 10, 2001 Word Count: 2466 Research Question: How did Ferdinand E. Marcos eventually fall from power? INTRODUCTION Ferdinand E. Marcos was the longest reigning Philippine president in history. His rule spanned 20 years, beginning in 1965 up to his downfall in 1983. He was the first and only president re-elected so far (first in 1969 and second in 1981). After his second term, corruption in his administration was rampant. For 20 years he ruled the Philippines with an iron fist, and amassed a personal fortune. According to all sources, he managed to prolong his term for so long through his â€Å"private military† (Sonia M. Zaide, 217) that crushed or silenced opposition against him. His attempts to prolong his term however, were also responsible for the dissatisfaction of his people and the growth in opposition and against him which eventually led to his downfall, after the assassination of Benigno Aquino on 1983. BACKGROUND ON MARCOS’ RISE TO POWER Marcos came from a rich and politically prominent family in Ilocos, a province in the northern part of the Philippines. He began his political career in 1949, being elected to the House of Representatives as congressman of Ilocos. In 1965, he was elected as President of the Senate. He then (as a Nacionalista, one of the 2 main political parties) ran for president and gained victory over the incumbent president, Diosdado Macapagal. Marcos promised to â€Å"make the nation great again,† and during his first term of 6 years Marcos gained widespread popularity through his extensive economic and political achievements. In 1969 Marcos became the first (and up to the moment, still the only) re-elected president of the Philippines. During his second term however, Marcos lost popularity due to the extensive graft and corruption of his favoured cronies, and the human rights violations of the Marcos administration when he proclaimed Martial Law on September 21, 1972. He lifted Martial La w in 1981 after reducing the opposition by intimidation. During his second re-election in 1981, Marcos had only one opponent, Alejo Santos of the Nacionalista party, because Senator Benigno Aquino (who was his only credible opponent) was living in exile in the United States. During the next years, the Philippine economy was considered â€Å"the sick man of Asia† (Time Magazine). In 1982, Marcos was sickly and he was absent in many official ceremonies. During this time, his wife (Imelda Marcos) and her  cronies were unofficially running the country. It was during this time, when on August 21, 1983, his long time rival, Benigno Aquino (wife of Benigno Aquino), returned to the Philippines. He was assassinated in broad daylight in the Manila International Airport by one of the government military escorts and this incident was captured by camera (Don Lawson, 1). This infuriated the Filipino people, which was the final blow to his rule. After days of mass rallies and demonstrations all over the country, he called as snap election as part of his strategy to maintain his credibility in the international body. He was declared the official winner because of massive vote buying and cheating and intimation. The mass rallies and demonstrations continued nationwide which paralyzed the government operations † for example, banks were closed and transport services were on strike, and part of the military rebelled, and all these led to the now popular EDSA Revolution (also known as â€Å"People Power†) on February 16, 1986 which toppled Marcos’ rule. ANALYSIS OF THE CAUSES OF MARCOS DOWNFALL The causes of Marcos’ downfall can be divided into two parts † long term causes and short term causes. Marcos’ acts of corruption which include: his attainment of large sums of money from the Philippine treasury during his reign, abuse of military power to suppress opposition and maintain a firm grip on presidency, and his political schemes to prolong his rule were responsible for creating an atmosphere of hatred and discontent on Marcos’ rule, under the overriding atmosphere of fear created by the resulting suppression of any threats to his power. These doings cultivated the seeds of dissatisfaction which soon developed into unified hatred towards Marcos’ reign. There was widespread discontent, but this discontent was still silent. The short-term or immediate cause of Marcos’ downfall was the Assassination of Ninoy Aquino. The â€Å"assassination brought Philippine’s economic shambles to world attention† (Fred Poole and Max Vanz i, 244) and lead to Marcos’ fall from power after the EDSA revolution. MARCOS’ MILITARY The military was the initial basis of Marcos’ power. Marcos’ military control provided him with a huge political advantage. Marcos used the military to create an atmosphere of terror, to discourage opposition and  eliminate any threats to his power to enable him to continue his rule over the country. During his reign, bribery and intimidation of voters during elections was rampant. As the corruption in the Marcos administration became widespread, demonstrations occurred as student activism rose, but were quickly suppressed by his military. An example of this is the â€Å"Battle of Mendiola† on January 1970, in which demonstrators tried to storm in the gates of the Malacanang Palace (the Philippine Presidential building, similar to the White House). It was the most violent of the student demonstrations (Florida C. Leuterio, 151). Due to the increase in violence Marcos imposed martial law in 1972. According to all sources consulted, there may have been a possibil ity that some acts of violence were planned by Marcos to ensure the legitimacy of his declaration of martial law. Since the constitution limited his presidency for merely two terms, he was due to step down on December 30 1973. However, upon the proclamation of martial law, he would be able to perpetuate his rule over the Philippines, because the 1935 constitution had not stated the limitations for the length of martial law (Florida C. Leuterio, 153). Marcos then used the military to detain Filipinos suspected of subversion. This included all critics/activists (ranging from students to professionals), and potential political opponents. They were tortured by their captors and many were then held in military detention camps. Marcos’ â€Å"military establishment tightened its grasp into a stranglehold through increased terror† (Fred Poole and Max Vanzi, 208). Although POLITICAL SCHEMES TO PROLONG HIS TERM AND GAIN POWER For more than 20 years Marcos was able to prolong his term. Through his political schemes and manipulations, Marcos was able to continue with his presidency despite the limitation of only eight consecutive years, the decline of his country’s economy, and the harsh conditions suffered by the majority of its citizens. Even before the presidential elections of 1965 Marcos received numerous military decorations which made him one of the most decorated heroes of World War II. Through this, Marcos gained popular American support, and gained an edge in the 1965 Elections. Sterling Seagrave (author of The Marcos Dynasty) states that Marcos had merely invented the feats made the Philippines most decorated World War II hero. Don Lawson (author of Marcos and the Philippines) however, does not state that Marcos has invented those feats. During 1971 a Constitutional Convention was held to rewrite the 1935  constitution which would then enable Marcos to continue in power under the new constitution. On 1973 he enforced the new constitution which would give him both the powers of a president and a prime minister (until one is elected). The constitution was ratified through citizen assemblies by raise of hands. Due to the prevailing atmosphere, the people adopted to the new constitution. During elections, Marcos engaged in massive fraud to ensure his victory. ILL-GOTTEN WEALTH According to Australian investigator Reiner Jacobi the Marcos rule was economically disastrous for the Philippines. Financial he discovered showed that Marcos had â€Å"systematically looted his country for over 20 years.† He states that the Marcos’ taken at least $5 billion in â€Å"ill-gotten wealth† and that there is other material suggesting that Marcos took even more. Marcos â€Å"used his favourites†Ã‚ ¦ to take charge of the nation’s natural and human resources and its big economic ventures.† Journalist Ron Whittaker goes on to prove that as Marcos and his family amassed a personal fortune, through stealing from the Philippine treasury. He states that â€Å"Despite the hundreds of millions of dollars from the United States each year, Marcos’ government was falling increasingly into debt; and, even as his personal fortunes rapidly escalated, the majority of his people were living in poverty.† Although Marcos succeeded in intimidating his opposition and prolonging his term, his abuse of power exposed his corruptness to the people, which thus created an atmosphere of discontent towards him which continued to build up and would eventually cause his downfall. However, due to the atmosphere of fear Marcos has created, there was still a lack of motivation to call for reform and stand up against the threat of Marcos’ military. THE AQUINO ASSASSINATION AND THE EVENTS THAT FOLLOWED The final blow happened when Benigno Aquino, his only credible opponent, was assassinated by his military escorts, with this incident captured in video tape and broadcast in the foreign media. The event shocked the not only the Filipino people, but the whole world, as footage of the assassination was aired internationally (Sonia M. Zaide, 217). The Assassination was the last act of injustice that the people would take from Marcos. This infuriated the Filipino people, who  became bold because of their outrage. Benigno Aquino was transformed into a national idol (Florida C. Leuterio). It created anger in the Filipino’s that was able to supersede the atmosphere of fear. His death awakened the Filipinos to the â€Å"Evils of Marcos.† In addition to this militant groups (the August Twenty-One movement, Justice for Aquino, Justice for all, and BAYAN† were organized. They staged demonstrations calling for an end to Marcos’ rule. Aquino’s death caused a ch ain reaction of events that eventually forced Marcos out of power. As the Philippine economy deteriorated the Filipinos became poorer and poorer. Anti-Marcos demonstrations cause the decline of the tourism industry. Rampant corruption discouraged foreign investors. High oil prices, and the price decline of traditional exports caused a slow down in economic activity. The government was forced to borrow from the IMF, World Bank, the US and its foreign creditors pressured Marcos to implement reforms as a condition for granting him economic and financial assistance. Their actions were like a vote of no confidence to the Marcos rule and legitimacy as the living conditions of the Filipino’s had furthermore worsened (Florida C. Leuterio, 165). Their actions resulted in further depreciation of the Philippine Peso. As many businesses slowed down, there were mass layoffs which, in turn, caused more poverty and the further disenchantment of the people. Marcos’ effort to survive by calling and winning the snap elections on 1986 failed because of the massive cheating, and the people truly believed Cory Aquino was the true victor. Doubt and scepticism on Marcos furthermore threatened his rule. A group of reformist lead by Fidel V. Ramos, and Juan Ponce Enrile made plans to face the Marcos loyalist and overthrow Marcos. In an attempt to prevent a bloody civil war Cory Aquino launched civil disobedience nationwide in a movement which became known as EDSA or â€Å"People Power.† The Filipinos made a human barricade that prevented the two forces from attacking each other. US senator Paul Laxalt advised him to â€Å"cut, and cut clean.† Marcos was forced to exile in Hawaii on February 25, 1986. According to Dr. Florida C. Leuterio (author of Philippine History and Government), despite the hopelessness of the situation, Marcos had not yet  give up and attempted to impose martial law once again. The plan was code-named â€Å"Everlasting.† He was to send soldiers dressed in civilian clothing to spread violence and terror. This incident would eventually give him an excuse to once again impose martial law and thus, furthermore prolonging his term. However, before he could put his plan into act, the EDSA revolution took place. This truly exposes the corruptness of Marcos’ and furthermore proves his unjust nature and his illegitimacy as president. Sterling Seagrave adds that just before the inauguration of Cory Aquino, Marcos had contacted Enrile offering to set up a provisional government were Cory Aquino, Enrile, and Marcos would rule. This goes to show Marcos’ sheer determination to retain his presidency and prolong his term. ROLE OF THE MEDIA IN THE DOWNFALL OF MARCOS Ron Whittaker (a journalist who studies the effects on Media in politics) believes that the media has had a crucial role in contributing to the downfall of Marcos (both in exposing his corruption, and also in helping organize the EDSA revolution) and that Marcos might have retained his presidency if it were not for the media. He states that because of Marcos’ control over the media, the international community was not aware of the situation in the Philippines because unless certain attention is required, the â€Å"international media take their cues from local press coverage.† I strongly support this and believe that the media was essential in the downfall of Marcos. The assassination of Benigno Aquino was a key factor and the immediate cause of Marcos’ fall from power. It was the event that fuelled the Filipino’s angers and made them take action. It was the event that caused international eyes to observe the situation in the Philippines. This in turn, forced Marcos to think twice before carrying out his military abuses. CONCLUSION The Marcos experience teaches us that power corrupts and creates a situation which ultimately impoverishes the country and its people. The main cause of Marcos downfall is the suffering and poverty he created during his rule. Not even his control of the military can sustain him forever. Eventually he lost major support of the people, the church, and part of the military mutinied. (Unlike Lee Kuan Yu of Singapore who was also an  authoritarian leader, but he was perceived as honest and he was able to improve the economy of Singapore and the standard of living of his people. Even up to now Lee Kuan Yu is still active as a senior minister and highly respected all over the world, a sharp contrast to what happened to Marcos). Even if Marcos did not commit the fatal mistake of assassinating Benigno Aquino, I believe that it merely hastened the process and it would be only a question of time, before he will replaced by the people in a popular election or uprising. In this world of modern television and CNN, a corrupt leader like Marcos would not be able to sustain his image as a legitimate leader of his people. In many ways, the experience of Soeharto, who also had complete control of the military, also proves that a leader today cannot survive if there is widespread corruption and poverty in his country. With the help of the pouring international media, Marcos not only gained opposition locally, but abroad as well, and as a result of this Marcos was eventually forced to step down from power.

My Personal Management Plan Essay

This plan will help with the discipline aspect of the classroom and helping students know what expectations are when entering into the classroom if done on a consistent basis. In the beginning of the school expectation should be given so that students are aware of the goals that are expected of them collectively and individually. With this classroom management plan there are a few things that should be taken into consideration in order for the plan to be of success. Shown below are a few steps that could be used in the classroom: Step 1, It’s Easier to get Easier, Step 2, Fairness is key, Step 3, Deal with disruption in the classroom as little as possible, Step 4, Avoid confrontation in front of students, Step 5, Stop disruptions with a little humor, Step 6, Keep High Expectation in your Classroom, Step 7, Over plan, Step 8, Be Consistent, Step 9, Make Rules Understandable and Step 10, Start everyday fresh. Having a classroom management plan set in place for your classroom will give students goals to look forward to accomplish with taking their education seriously for their future. My Personal Classroom Management Plan My personal management plan will start off with a motivational quote of the day that will encourage students daily. With this motivational quote daily will be followed along with the ten steps that makes up a successful classroom management plan. The first step is called it’s easier to get easier and this is simply setting the tone of your classroom day one with your students because believe it or not students come in scoping to see what they can and cannot get away with in their classroom. Secondly, fairness is key this is making sure that all students are treated the same overall unconditionally because they pick up on favoritism within the classroom. Thirdly, deal with disruptions with as little interruption as possible. This is saying instead of stopping completely in the middle of your lesson to chastise a student for not paying attention try calling on the student with a question in reference to what the class discussion is to alert them that you do see them off task and this should help them get back on task. Fourthly, it is important to avoid confrontations in front of students even though in some cases you can make your point that way but every disciplinary action should be handled on a personal note so that you don’t lose a chance of teaching that student because of embarrassment. Fifthly, stop disruptions with a little humor. Sometimes classrooms can seem so serious all the time and even though that student may have disturbed the flow of the teaching the class may need that moment of laughter to break the ice for second and then get back on track. Sixthly, keep high expectations in your classroom. Always expect nothing but the best from your students academically. Expect nothing but positive behavior in the classroom. Expect for your students to know that there is a time and place for everything and that they know when to determine that time at the sound of your voice when you start the day off with what the expectations are for the day. Seventhly, over plan each day so that there is no free time for the classroom to go another route in a way that you do not intend for you class to go. There is never too much work on one topic just in case the lesson doesn’t go as long as intended you will always have extra activities. Eighthly, be consistent being consistent is what makes the flow of the classroom go smoothly throughout the day and throughout the school year. As a teacher being strict one day and lenient the next day will cause for your students to lose respect for you and will tend to now try and run over you because they now feel like they can get away with misbehavior. Ninthly, make rules understandable, all rules should be short simple and precised of what is expected and what is not expected of them and consequences should be known ahead of time so that no surprises are made and when inappropriate actions are made they already know what is going to happen to them because of that action. Last but not least, start fresh every day, each day is a new day and should be handled in such a manner no action from the day before should role over into the next day. Me as a Teacher!!! As an educator I see myself as a positive role that students can look up to. As an positive role model I must conduct myself with a positive and respectful attitude. My students will know the importance of giving respect to receive respect and this is something that I go by no matter what the age is everyone deserves respect. I see myself as an educator that is passionate about what it is that I do. I want nothing but the best for my students and want to see each and every one of them prosper in success with their future endeavors. As a teacher I feel that it is my duty to go the extra mile in making sure that they are successful to face society and whatever else that may be put up against. As an educator it is my duty to nurture and love these students as if they were my own being that they are with me majority of the time in a day and five days of the seven days in a week. It is important for me to understand that all students are not coming from positive households and to make the time at school meaningful and worthwhile that there is hope and another look of life than what they may see each day when leaving school. It is my duty to be a responsible leader and educator because I have influential students’ lives in my hand. What’s expected from the Students!!! What I have come to realize is that students/ children like structure. It is important for them to know that they cannot run over their teacher or any adult. Everyday my students will be greeted and at the starting of the class they will be reminded of classroom expectations. Students will be required and held accountable for the following responsibilities: †¢ Self- Control †¢ Positive attitude as a person and in the classroom overall †¢ Saying I CAN’T is not an option †¢ Quitting is not an option when something is challenging †¢ Respect one another as they respect all adults Respect their classroom as their learning academic environment space †¢ Encourage one another!!! Atmosphere of the Classroom!!! It is important to make sure that your classroom is conducive for learning. This is simply having your classroom free of clutter. If the classroom is chaotic with mess and everything is all over the place then nine time out of ten then students and t he classroom will be ran in chaos because the brain is clouded with the unorganized materials that is around the individuals. Classrooms should display the way of learning that students take on. As the leader of your classroom sanctuary it is important that you make sure the atmosphere is positive, welcoming and comfortable for your students. Student Conduct!!! It is important that you get your students to understand the importance of their education, how valuable it is and beneficial for their future. Students must know how to conduct there selves accordingly in how they want others to see them as behaved students. I believe when students are included in making decisions in the classroom that you get a different response from them as a hold. This gives students a responsibility and makes them feel included in how they believe the classroom should be run. This helps to cherish the rules more in the classroom because they feel that they had something to do with the decision made for the rules. It is important to make sure that lessons are exciting to your students so that the lessons keep their attention throughout. Behavior Intervention Strategies!!! Behavioral strategies are very important because all students are not going to behave in a way that you expect for them to behave. In some cases you always have one student that want to see how far they can push you with their behavior. With this plan you can nip it in a bud right away and let them know that their behavior is unacceptable and will not be tolerated in the classroom. Also, there are positive and negative behaviors that either needs to reprimand or praised for what it is that they have done. Strategies that can be used are as follow: †¢ Rewarding a student when they have followed instructions or done something that was worth bringing attention to so that they know what it is that they you are expecting from them. †¢ Being consistent with consequences when rules are broken. †¢ Be mindful that some students do things because they need that extra attention that they may not be getting at home from their parents. †¢ Always, be ready for change in case the way you intended to correct a situation does not work with this particular student. Introducing the Plan!!! Introducing the classroom management plan to the classroom will simply discuss expectations of them as a group and individually. They will know and understand that our academics will not be taken lightly and should be done to the best of their ability. They know in the beginning that we all will respect one another collectively and no one will be disrespected in the classroom. This plan will be presented at the beginning of the school year to the parents and the students and expectations will start each school day so that students know that I am serious and take what it is that I do serious as well. Overall, having a classroom management plan in place for your classroom will help the day by day and school years go so much smoother. Not only having the plan makes the classroom run smoother but being consistent with what you stand by keeps students in place and in line and have a better success rate. It is important and okay for your students to know that you will do whatever it takes for them to above level but they must do their part as well and that’s with will power, courage and motivation.
